Terms of Service

GENERAL
There is a chance I might decline an order if the character is someone I cannot draw well, every commission is influenced by my style strengths, and preferences (read below at do's & don'ts).
Provides me with a finished character design, which means has been designed by you (has been drawn by you or other artists), has full references, and not separated images from different sources (Including AI Generated). If not, I'll charge the fee.
The commission result (with a watermark) will be uploaded to our portfolio. Publishing and privatization of personal commissions can be considered and discussed, especially for marketing purposes of commercial work.

PAYMENTS
-All payments must be processed via Local Bank (Mandiri QRISS) for IDR, VGen for International Client.
-Payments must be done UPFRONT.
-Refunds are unavailable. Unless I'm the one who have to cancel the commission due some circumstances.
-Only participate in any transaction if you can pay off your ability. Chargebacks against us due to irresponsible buying will automatically result in a permanent blacklist.
REVISIONS
-There won't be any active progress updates since it's a Surprise Me commission.
-Revisions are only possible when I miss important details of the character (wrong eye color, wrong hair color, etc.).
DEADLINES AND DELIVERY
-The working process will take 3-7 days depending on my real life situation and the queue.
-Please do tell me if you have a deadline for your request.
-You will receive only a full-resolution digital file of the commission only on VGEN or Google Drive (for client outside VGen). No physical item will be shipped to your home address.
PRICING
-The commission price is only for personal use.
-All commissions that are used for YouTube, Twitch, or any broadcasting platform will be charged a commercial fee. Do not use the artwork for commercial use unless discussed beforehand; extra charges or royalties will apply for commercial projects.
RIGHTS AND USAGE
-Personal Use: The final artwork is for personal use only, such as printing for personal use, sharing on personal social media, or displaying it privately.
-Commercial Use (Streaming/Content Use): The final artwork is used as an asset in streaming or other content creation platforms. The commissioner may use the artwork as stream's visual branding and promotional materials related to content. The artwork may not be used for profit.
-Commercial Use (Merchandise/Ads/Prints): The final artwork is used for profit. The commissioner may reproduce, distribute, and sell artwork on products, digital platforms, or in any other form intended to gain profits.
INTELLECTUAL PROPERTY RIGHTS
-Artist's Copyright: The artist will retain full copyright and intellectual property rights to the artwork created unless a commercial license is purchased. Copyright includes the exclusive right to reproduce, distribute, display, and create derivative works based on the artwork.
-Client’s Rights: Upon full payment for the commissioned artwork, the client is granted a license to use the artwork for personal, non-commercial purposes, such as displaying it online or printing it for private use. The client does not own the copyright to the artwork but holds a personal-use license that allows for the enjoyment and display of the art.
-Rights for Commercial Use: If the client wishes to use the artwork for commercial purposes (such as for selling prints, using it in marketing materials, or producing products with the artwork), a separate commercial license must be purchased. This license allows the client to use the artwork for specific commercial purposes outlined in the license agreement (e.g., product creation, merchandise, etc.). Without a commercial license, the client cannot legally use the artwork for commercial resale or profit.
-Both personal and commercial works made by Kachang are NOT authorized for use in any blockchain-related technology including NFTs and any form of cryptocurrency.
